Remember that FSTs are highly inaccurate—failure can be attributed to health conditions or unstable shoes just as much as intoxication—yet they can still be used against you if your officer thinks that you have failed. It is actually not legally required that you take these tests. You may politely refuse and ask to speak with your lawyer.
- 4. If you refuse to perform FSTs, or if your police officer thinks you have failed them, he will probably ask you to take a roadside breath test. You may also refuse this and ask for a blood test at the station, but you may incur penalties for doing so.
